Terms and conditions of sale

General

In advance, it is specified that the term Company refers to the company Leucate Evasion Marine,
The purchase of a ticket implies acceptance of these terms and conditions, which passengers are deemed to have read and understood, and their ignorance cannot in any way prevent their application. The Company’s liability cannot be extended beyond the present terms and conditions.

Article 1: Reservations

The company accepts reservations via the Internet at https://leucate-evasion-marine.com/, by telephone, and at our sales counter.
The customer will be required to pay for the ticket following this reservation under the conditions set out in article 4 of these terms and conditions.

Any special health conditions must be declared at the time of booking, as set out in article 5 of these terms and conditions.

The company is not authorized to carry passengers with reduced mobility.

Seats are not numbered or assigned.
The seats of passengers absent 10 minutes before departure time are allocated to waiting passengers.
Tickets are valid for the date and time of the service booked for the current year’s operating season.
Tickets are personal, non-transferable, non-changeable, non-refundable and subject to cancellation conditions.

Article 2: Excursion times, routes and prices

The company offers its passengers several routes throughout the day, at different fares.
Schedules and routes are defined by the company. The website, as well as the brochures, billboards and posters published by the company and presenting the tours, do not constitute a contractual document. The information provided is for guidance only.
Programs are subject to change. These timetables and itineraries may change during the season, depending on the weather, the temperature, sunrise and sunset times, and the opening hours of establishments (harbors, restaurants, etc.) that can accommodate passengers on the proposed excursions. Like timetables and itineraries, fares may vary at any time depending on the elements or the economic situation (surcharges, fuel, etc.) or changes in taxes (VAT, port and custom taxes).
All prices include VAT.
Passengers will be informed of timetables, routes and fares at the time of booking via the website or after contacting the company for further information. However, the departure and arrival times announced at the time of booking may be brought forward or delayed in the event of any difficulty encountered by the ship’s captain. In addition, weather conditions may force the ship’s captain to modify the excursion route originally planned.
If necessary, the tour price will be adjusted.
In all cases, passengers will be kept informed of any changes to schedules, fares or routes.
Under no circumstances will such a change justify the payment of any compensation to passengers.

Article 3: Cancellation

3.1 Cancellation by the company
The company reserves the right to cancel a tour, without notice or compensation, if the minimum passenger quota is not reached (15 full-fare adult passengers), in the event of force majeure, unforeseen circumstances, bad weather, damage, malfunction of any kind, for safety reasons or for any other legitimate reason.
The company will make every effort to offer passengers an alternative, and in particular to postpone the excursion, depending on the company’s availability, without passengers being able to claim any compensation or indemnity whatsoever.

If no alternative solution is offered or accepted, passengers may claim a full refund of their tickets from the company.

Refunds are made by the same method of payment used by the passenger when booking.

3.2 Cancellation by the passenger
Passengers may cancel their booking free of charge or change it for any reason up to 72 hours in advance.

After this deadline, less than 72 hours before departure, no changes, cancellations or refunds will be possible.

Article 4: Accepted methods of payment

The company accepts payment by credit card, cash, ANCV or bank transfer (privatization).
Tickets are paid for at the time of booking.
Tickets are only issued against full payment.
The company no longer accepts payment by cheque.

Article 5: State of health

Passenger health

Any special health conditions must be declared at the time of booking.
In addition, any passenger with a disability, a proven health problem, or physical conditions incompatible with the proposed excursion (hernia, osteoporosis, etc.) must inform the company at the time of booking.

Pregnant Women
This type of boat is not recommended for pregnant women, and is forbidden for those over 5 months pregnant. In addition, depending on marine weather conditions, the company reserves the right to refuse boarding to pregnant women. If in doubt, ask your doctor for advice before booking.

Passengers with disabilities :
The company is not authorized to carry passengers with reduced mobility.

We recommend that people with disabilities make themselves known before purchasing a ticket, in order to determine the feasibility of boarding. In the event of non-declaration at the time of booking, the Captain may refuse boarding to passengers whose state of health is incompatible with the excursion, without the passenger being entitled to any reimbursement or compensation whatsoever.
The passenger will still be required to pay for the ticket and no refund or compensation will be made.

Article 6: Boarding

Passengers embark and disembark in the presence of the captain, who directs the passengers and instructs them on how to board and disembark.

Conditions
Passengers must present themselves in front of the boarding area 15 minutes before departure.
No delays are accepted by the company.
In the event of delay, even with a ticket, passengers have no recourse against the company if they are unable to board.
Only passengers who have reserved their seat and show a valid ticket are allowed to board.
Passengers must keep their tickets in good condition throughout the journey.

Accessibility
Bicycles, baby carriages, strollers (even when folded), motorcycle equipment and other bulky items are not allowed on board and cannot be taken on board.

Passengers with disabilities :
The company is not authorized to carry passengers with disabilities or reduced mobility.
Access on board is not possible due to the inaccessibility of port facilities for safe embarkation and disembarkation, and the dimensions of the ship’s access doors make it physically impossible for electric, mechanical or manual wheelchairs to board….
In the event of non-declaration at the time of booking, the Captain has the right to refuse boarding to passengers whose disability is incompatible with the excursion, without being able to demand reimbursement or compensation of any kind whatsoever.

Article 7: Safety and liability

Safety recommendations

Minors are allowed on board if accompanied by their parents, and remain under the latter’s full supervision and responsibility.

To ensure everyone’s safety, we ask passengers to follow the captain’s instructions during embarkation and disembarkation, and for the duration of the crossing or excursion.

For your safety, the company invites you to take into account the particular behavior of a ship at sea, which may present platform movements. It is recommended to limit travel on board ships.
Parents are responsible for their children’s behaviour and safety, and must ensure that their children do not run on board or climb onto railings, caissons, seats or life-saving appliances.

It is strictly forbidden to smoke or vapourize on deck, in the toilets or in any other enclosed area of the ship.
Passengers are strictly forbidden to carry flammable, explosive or dangerous materials, firearms or knives, or to consume alcohol or drugs on board, and the Company is at liberty to take any measures to prevent them from doing so and to take any legal action.

Company staff may refuse to sell a ticket, and the ship’s Captain may refuse embarkation and transport to any person whose behavior could be detrimental to public order or endanger the safety of other passengers on the ship.
Passengers must be respectful of shore staff and the captain.
The captain asks passengers to behave responsibly:
By avoiding risky situations, supervising their children on the embarkation quay and on board, moving with care on the ship, which is by nature a different environment from land-based facilities, protecting their personal belongings, camera, camcorder or other items from any spray, paying attention to safety announcements and respecting the instructions given by the captain.

Personal items

Neither the company nor the captain are responsible for the personal belongings of passengers on board. Nor is the company liable for cash, securities, jewelry and other items carried by passengers, or for their theft, loss or deterioration due, for example, to natural movements of the ship, sea conditions or other causes.
In the event of theft, loss or damage, no compensation, refund or indemnity will be made by the company.

Swimming
The company is not a diving or snorkeling club. Nonetheless, it offers swimming breaks during its excursions.

Swimming is not compulsory and is at the passengers’ own risk.
Passengers therefore certify that they know how to swim.
The captain reserves the right to cancel a swim break due to weather conditions.

Stopovers
The captain may suggest stopovers to his passengers during excursions.
The company and the captain are not responsible for passengers and their belongings during these stopovers.
No swimming equipment will be loaned during these stopovers.

The company cannot be held responsible for any difficulties encountered by passengers in a shop or establishment during the stopover.

The captain gives passengers a schedule for the end of the stopover and return to the ship. Passengers must report to the ship 5 minutes before the departure time given by the captain.

No refund or compensation can be demanded from passengers who are unable to board due to delay.

Liability
The captain is the sole master of his ship, and has sole authority to judge whether or not weather conditions allow the excursion to go ahead, and to inform passengers of the safety instructions to be followed.

During embarkation and disembarkation operations, as well as during crossings and coastal cruises, the Company’s liability is limited in all circumstances to the period during which passengers are under its direct control on board its ship, excluding all installations and works in the public domain.

Neither the Captain nor the Company can be held responsible for diversions, modifications, service interruptions or delays in ship departures and arrivals, or for the non-coincidence of arrivals, departures or connections of ships, planes and trains.

The Company’s liability can only be invoked within the framework of the texts applicable to maritime transport. The allowances that can be granted are limited by these texts.

Article 8: Special conditions, Gift vouchers, Groups, Conventions and Privatization.

Group: a ‘group’ is defined as a group of paying customers who must travel together, and who are subject to a single booking and payment.
Reservations are validated once the group manager has accepted the estimate, dated and signed it with the words ‘bon pour accord’ (‘good for agreement’). The quote is binding on the referrer, and if any member fails to show up at the boarding gate, the booking will be due in full.

Privatization: means the use of the vessel with skipper, for a half-day or a full day. Depending on your wishes, a route will be defined in advance, and a fuel package will be included in the price of the service for a given duration and a pre-defined navigation zone.
Full payment is required to validate the reservation. Full payment must be received no later than 15 days before departure.

Gift card valid for 1 year from date of purchase, no refunds on gift cards.

Article 9: Vessel regulations

The company’s boat is subject to European regulations on passenger transport, as well as to Division 241 attesting to the vessel’s compliance with technical standards for the safety of commercial pleasure craft with a hull length of 24 meters or less.
The captain holds a Brevet de Commandement et de Chef Mécanicien. These Brevets also imply possession of a first-aid training certificate, and a CGO certificate (Certificat radio d’opérateur).

All seafarers are required to undergo an annual physical fitness examination by a seafarers’ physician.
Special insurance covering all passengers.

The company reserves the right, at the Captain’s discretion and for reasons inherent to navigation, to make stopovers other than those planned or to modify the initial route.
The captain is authorized to tow, to assist vessels in all situations, to divert, to carry out all rescues and all transshipments, passengers thereby waiving all claims.

In accordance with article 241-4.01 of division 241 of the French maritime safety regulations, the company is required to draw up a register of persons embarked, mentioning the surname, first name and age category of each passenger or child under one year of age.

Article 10: Complaints

Any complaint against the company must be made within 15 days of the date of the excursion, by registered letter with acknowledgement of receipt to the head office of Sarl Leucate Evasion Marine 3 chemin de Moncal 11490 portel-des-corbieres.

Article 11: Applicable Jurisdiction

Any dispute arising from the application of these terms and conditions of carriage shall be subject to the sole jurisdiction of the Narbonne Commercial Court. Only French law is applicable.
